Signing Up and Opting-In to the Service

Enrollment in the Service requires you to provide your mobile phone number and agree to these terms and conditions. Note that you may not enroll if you are under 18 years old.

Before the Service starts, you will need to agree to these Terms. dreamspacecreators.com reserves the right to stop offering the Service at any time, with or without notice.

By opting into the Service, you:

  • Acknowledge that you do not have to agree to receive messages as a condition of purchase.
  • Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.

Charges and Carriers

You acknowledge that you are responsible for any message, data, or other costs incurred (usage, subscription, etc.) as a result of using the Service.

The Service may not be available on all wireless carriers. dreamspacecreators.com may add or remove any wireless carrier from the Service at any time without notice. dreamspacecreators.com and mobile carriers are not responsible for any undue delays, delivery failure, or errors in messages.

To Stop the Service

To stop receiving text messages from dreamspacecreators.com, text the word STOP to any of the text messages you have received. This is the exclusive method for opting out.

For Services operated through a different number, text STOP to that number to opt out. Your opt-out request may generate either a confirmation text or a text request to clarify the text message program it applies (if you have more than one). To complete your opt-out, please provide the requested clarification.

You acknowledge that the text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that dreamspacecreators.com and its service providers will have no liability for failing to honor such requests. In addition, if you unsubscribe from one of our text message programs, you may continue to receive text messages from dreamspacecreators.com through any other programs you have joined until you separately unsubscribe from those programs. These Terms still will apply if you withdraw the consent mentioned above or opt out of the Service.

Inquiry Submission: You understand that you are submitting an inquiry as to home improvement services through Dream Space Creators.

The Site acts as a venue to allow Providers to offer home improvement opportunities to consumers (each, a "Prospect"; all Prospects and Providers are referred to together as the Site's "users") who have visited one of our Sites or affiliated sites and submitted a request. We do not offer any products or services described on the Site directly, nor do we engage in other consumer financial transactions.

4. Personal Use

We generally do not charge users to access the public portions of our Site. Accordingly, we grant each user a limited, revocable, non-exclusive license to access the Site in order to, as applicable, view or make legitimate inquiries to us regarding our Service, all in accordance with these Terms.

Any other use of the Site or the Service is expressly prohibited. This limited license does not include any right of:

(ii) THE UNAUTHORIZED USE OF YOUR ONLINE ID AND PASSWORD COULD CAUSE YOU TO INCUR LIABILITY TO BOTH Dream Space Creators AND OTHER USERS.

10. Limitation of Liability

IN NO EVENT WILL Dream Space Creators, OUR AFFILIATES, OFFICERS, MEMBERS, MANAGERS, DIRECTORS, AGENTS AND/OR EMPLOYEES (COLLECTIVELY, THE "Dream Space Creators GROUP") BE LIABLE FOR:

ANY LOST PROFITS OR DATA OR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM OUR SITES OR SERVICE, THESE TERMS, YOUR USE OF THE SITE OR THE SERVICE.

THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM BREACH OF CONTRACT, WARRANTY, TORT, NEGLIGENCE, OR ANY OTHER CAUSE OF ACTION.

MAXIMUM LIABILITY: IN ALL EVENTS, OUR LIABILITY TO YOU OR TO ANY THIRD PARTY IN ANY CIRCUMSTANCE ARISING OUT OF OR IN CONNECTION WITH THE SITE OR THE SERVICE IS LIMITED TO $100.00.

11. Disclaimer of Warranties

The Sites and the service are provided "as is." We expressly disclaim all express or implied warranties, including, without limitation, non-infringement, merchantability, fitness for a particular purpose, completeness, and accuracy.

We do not warrant that the functions contained in the Sites will be uninterrupted or error-free, that defects will be corrected, or that the Sites or the server that makes it available is free of viruses or other harmful components.

12. Release

In the event that you have a dispute with one or more other users of the Site (including disputes between Providers and Prospects), you hereby agree to release, remise, and forever discharge the Site and each member of the Dream Space Creators Group from any and all claims, demands, and damages arising from such disputes.

California Residents: You waive California Civil Code Section 1542 regarding unknown claims.

Non-California Residents: You explicitly waive the terms and protections of any statute of your own state that has a similar import or intent.

13. Indemnity

You hereby agree to indemnify, defend, and hold the Site and each member of Dream Space Creators (the "Indemnified Parties") harmless from and against any and all liability and costs (including attorneys' fees) incurred by the Indemnified Parties in connection with any claim arising out of your use of the Sites, any act by you, or any breach by you of these Terms.

14. No Agency

The relationship between Dream Space Creators and each user is that of independent contractors. No agency, partnership, joint venture, or employee-employer relationship is intended or created by these Terms.

15. Amendments

We reserve the right to change, modify, add, or remove any portion of these Terms at any time. We will post a revised version of these Terms on the Sites, and the revised Terms will be effective immediately thereafter.

16. Copyright Infringement (DMCA)

If you believe in good faith that any Content on the Sites infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the necessary information in writing (see 17 U.S.C.A. 512(c)(3)).

Counter-Notice:

If you believe Dream Space Creators removed your Content by mistake, you may file a counter-notice. Please include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the applicable jurisdiction if your address is outside the USA).

18. Miscellaneous

Termination: We may terminate any user's access to the Site due to a breach of these Terms.

Statute of Limitations: Any claim must be commenced within one (1) year after the cause of action arises.

Severability: If any provision is found unenforceable, the remainder of these Terms shall continue in full force.
